Obama Administration Overrules iPhone Trade Ban

Back in June, the U.S. International Trade Commission issued an import ban on the iPhone 4 and iPad 2 3G due to patent violations. Now, the White House has exercised its privilege to overrule the ban. In his letter to the ITC (PDF), Ambassador Michael Froman said 'he was not making a decision about the merits of Samsung's case, or its right to seek compensation. Rather, he emphasized that because the patent in question was now a widely held technology standard, banning the products in question would be too disruptive to consumers and the economy.' This is the first time an ITC decision has been overruled since 1987.
Wow... just wow. Not sure I can comment on this without being put on a "watched" list by the NSA if I'm not already on one but I'll try. First PBS's refusal to support Andriod, and now, the White House with Apple's dick squarely in their mouth. It's a bad day to be American who doesn't work for the mass media or big gov. __________________

Perhaps they misplaced Samsung as being part of NORTH Korea and the NK nuclear program? Maybe they just don't like Koreans? Maybe Silicon Valley cash is so infused in their DNA that they'll do anything to help out their political bankers?

There's nothing a politician likes more than throwing their weight around. That and campaign donations from huge corporations, ie: legal bribes.

Well they pay politicians to get their way legally. Sounds like a bribe to me. Only difference is it's out in the open, not hidden.

I have mixed feelings on this. DC has been at odds against Apple for a while, so it's hard to say this is favoritism or corporatism. I'm also not a big fan of patent law, so seeing that law not being enforced doesn't really evoke any anger from me, though I don't want to see Apple be given preferential treatment in this regard. But again, given recent history between Apple and DC, I'd be hesitant to say that's whats going on here, unless some serious behind the scenes shit went down very recently.

Well, after googling it, it looks like Apple's lobbying efforts have increased since Jobs died, so maybe thats exactly what this is. Carry on.

What happened with Microsoft is they ignored Washington for most of their history feeling they'd be left alone.

Then a competitor (Netscape) lobbied to have them brought up on antitrust charges.

This cause MS to begin lobbying, spending money to buy politicians.

Now MS lobbies heavily all over the place.

I assume a similar thing happened here. Washington throws its weight around, company freaks out and plays the lobby game and achieves preferential treatment over time. The cycle is self-perpetuating.

Like the iphone is going to be pulled off the shelves? No.. The judge ruled as he saw the law. The administration thought, mmm the iphone is pretty much a commodity at this point. Maybe we should use common sense and not let a case brought for the sake of getting apple stuff off the shelf and samsung stuff on the shelves dictate what happens here.

Everything seems legit here. Thanks Obama.

Except that isn't how the system is supposed to work. Now, I know you're a moron and can't be logically expected to know anything--but these processes take time. A lot of time. If the President is going to overrule every court ruling because, by the time the damn ruling is finished, the associated product is common then no patent is going to be worth a damn.

Well, the president apparently gets to decide which laws to enforce and which not to enforce, arbitrarily and without any court or congressional blocks, so there's that to consider.

How do I know this? Obama temporarily 'legalized' millions of illegals, enacting an 'executive' DREAM act with no legislation to support it. He's also decided to defy the legal deadline for the employer mandate in Obamacare, delaying it for a year despite the simple reading of the law stating when it would be enforced. He's also decided that he can kill Americans without any accusation in court of any sort, and has actually done that on several occasions.

So...what the hell do we need laws for? They're outdated. That's just a bunch of bitter clingers making noise. Laws. Hah.
